Louisiana, Supreme Court, Eastern District, New Orleans : Fazende v Hagan, December 1844 [printed]

Summary: Action to rescind a sale. Hagan, a Charleston slave trader, brought the orphan slave boy, Ben, to New Orleans and sold him to Fazende for [dollars] 390. Ben ran away and returned to Hagan's slave yard. Fazende reclaimed him. Ben ran away again and drowned in a river whilst trying to evade his purchaser. Judgment by default in the District Court because Hagan did not attend. Supreme Court reversed the decision because there was not conclusive evidence. Remanded for re-trial.
